Preliminary hearing starts February for Toronto cop, brother in alleged beating

A preliminary hearing is set to begin February for a Toronto police officer and his brother accused in the brutal attack of a Whitby teenager.
Const. Michael Theriault and Christian Theriault have been charged with aggravated assault, assault with a weapon, and public mischief in connection with the alleged beating of Dafonte Miller.
Miller, who was 19 at the time of the alleged attack last December, suffered broken bones and lost the vision in his left eye.
His lawyer alleges there was a cover-up of the investigation as the Special Investigations Unit wasn’t notified of the attack until four months later.
During the pre-trail hearing on Wednesday, it was decided that a 10-day preliminary hearing will take place starting Feb. 20 and continues until May 29. The judge placed a publication ban on the hearing.
The accused have also elected to be tried by a judge and jury.
The brothers did not appear in court on Wednesday.
Meanwhile, a protest was held outside the Oshawa Courthouse on Bond Street before the pre-trail hearing took place.
The Anti-Racist Network of Durham Region called for an independent investigation into the alleged police cover-up of the assault on Miller, as well as a public apology.
