No new trial for man who stabbed robber

SURREY (NEWS1130) – There will be no new trial for a man found guilty of stabbing and nearly killing a man who broke into his girlfriend’s home in Surrey. BC’s Highest Court doesn’t believe the man was acting in self-defence.

Clarence Rigler doesn’t deny stabbing the man several times.  The incident happened a couple of years ago after Rigler’s girlfriend told the victim he couldn’t stay at her house anymore.

The victim came back one night and broke in through a back window.  Rigler heard a noise and grabbed a knife.

His version of the story is he saw a silhouette, so he stabbed the person and then slashed at his legs without knowing who it was.

The trial judge ruled Rigler was acting out of anger and not fear and convicted him of aggravated assault.  A panel of three judges is now upholding the conviction.
