Rafferty trial resumes after jury was not present for a day of legal arguments

LONDON, Ont. – The trial of a man accused of killing eight-year-old Victoria (Tori) Stafford will resume, Wednesday, after a day of legal arguments.

It’s expected that last few witnesses in the Crown’s case against Michael Rafferty will be heard in the coming days before the defence is able to present its case.

Rafferty, 31, has pleaded not guilty to first-degree murder, sexual assault causing bodily harm and kidnapping.

His ex-girlfriend Terri-Lynne McClintic, who has already pleaded guilty to first-degree murder, has testified she abducted Tori on April 8, 2009, at Rafferty’s urging.

McClintic testified that Rafferty sexually assaulted the girl then she killed her, though until close to Rafferty’s trial McClintic told police that he had killed Tori.

The jury was not present for Tuesday’s legal arguments, so what was discussed cannot be reported until they begin to deliberate.
