Superior court judge finds city of Oshawa guilty in 2004 crash

TORONTO, Ont. – A superior court judge has found the city of Oshawa is mainly to blame for a 2004 crash that left two teens in wheelchairs for the remainder of their lives.

Shannon Deering, 19, and Erica Deering, 16, suffered catastrophic spinal injuries when their car veered off the road en route to a movie theatre on August 10, 2004.

Justice Peter Howden released his decision on Tuesday, saying that Oshawa is two-thirds responsible for the accident due to dangerous conditions on Coates Road. They also found Shannon – who was driving the vehicle at the time – one-third at fault.

The trial was restricted to the issues of liability, and a continuation of the trial concerning the damages suffered by the Deerings has not yet been scheduled.

Representing Shannon, lawyer Roger Oatley said the city of Oshawa has 30 days to decide whether to appeal, accept the ruling and discuss a settlement, or accept the ruling and move on to the damages phase.

Shannon and Erica’s total claims exceed $30 million.
