Support worker convicted of elder abuse sentenced to time served plus five months

A support worker convicted of sexually abusing an elderly client was sentenced to time served plus five more months in jail.

Danilo Alcala, 61, had already pleaded guilty to one count of sexual assault and one count of sexual exploitation of a person with a disability.

Alcala was “opportunistic” when he preyed on a vulnerable person in his care, Justice Rebecca Shamai said in her decision Wednesday. Alcala was hired to ensure the victim’s well-being, she continued.

“What a sad situation to have that care worker betray their trust … The victim was incapable of voicing the impact of the assaults on him.”

Shamai sentenced Alcala to five months in jail, plus the 18 months he had already served before the trial. He was also given two years probation, and ordered not to work as a personal care worker.

The Crown had asked for three to five years. The defense had asked for no further jail time.

It was the family of the elderly client, 95-year-old war veteran, that triggered the police investigation. The son of the victim had installed a camera in the living room where his father spends most of his time in order to keep an eye on him while he was away at work

Alcala had been hired by the family through Spectrum Health Care in 2015. In his first day on the job, he sexually assaulted his client and the assault was caught on a nanny cam.

In the course of the police investigation, two other complaints came to light. One of the elderly men involved in those complaints has since passed away. The Crown is not proceeding on a second sexual assault charge, related to that man.
