TORONTO, Ont. – The legal team representing Mayor Rob Ford has filed written arguments with the divisional court, asking for a stay order which would keep him in the city’s top job, pending the appeal of his conflict of interest ruling.

The Mayor’s lawyer, Allan Lenczner, will present three reasons when he begins his arguments why Ford should remain in his current position until the appeal process is complete.

Lenczner said removing the Mayor would do irreparable harm to both him and the democratic will on a couple of levels: It would be a loss of position that cannot be compensated by money, and if he’s not on the job, council would install someone else, or a byelection would be called to select a mayor.

Lenczner is also hoping to clarify if Ford can run in a byelection if one becomes necessary, or whether the ruling meant he cannot run for public office until the next municipal election cycle in 2014.  

However, Ford could be returned if he wins the appeal and has the ruling reversed.

Lenczner also plans to argue that Justice Hackland made some errors when contemplating Ford’s case – that he was wrong to conclude the city was within its powers to demand Ford pay back the donation, and was wrong to conclude the Mayor did not make an ” error in judgment.”

“I think if any one of the three is going to tip the balance, it’s going to the irreparable harm,” John Mascarin, a municipal legal specialist told 680News. “I think the divisional court will come down with the ruling relatively quickly.”

At Yonge and Bloor, Torontonians feel the Mayor should stay on.

“I think he should stay in office until the appeals process is complete,” one man told 680News.

“I think he can remain Mayor. The whole thing just boggles my mind,” said one woman.

Meanwhile, Don Cherry, a well-known supporter of Ford, told the Toronto Sun the Mayor has apologized for his mistake and should not lose his job. He has blamed the Mayor’s problems on ”left wingers out to get him”.

Cherry said Ford has dedicated his life to helping underprivileged kids, and would win in a landslife if there is another election.

Ford has been ordered to vacate the Mayor’s chair by December 10. The case will be argued in court on December 5.
