TORONTO, Ont. – A Toronto man who allegedly stabbed an intruder he confronted in his own home no longer faces charges, Thursday.

Thestar.com reports the Crown has withdrawn an aggravated assault charge after ruling there was no reasonable prospect that Moses Mahilal, 29, would be convicted.

Credibility issues with the Crown’s key witness Kino Johnson, who admitted he was unlawfully inside the upscale home when the stabbing occurred in July 2011.

Johnson has since pleaded guilty to break and enter and two counts of possessing stolen property.

Mahilal could have faced a prison sentence of 14 years had he been convicted.
