The only youth convicted in the 2005 Boxing Day shooting death of Jane Creba has lost his appeal.
The Toronto Star reports Jorrell Simpson-Rowe argued that his rights were breached when the Ontario Deputy Attorney-General ordered him to have a jury trial, despite his request to have a trial by judge alone.
Now 24 years old, he was only 17 at the time of 15-year-old Creba’s murder outside the Eaton Centre. He was convicted of Second-Degree Murder, Aggravated Assault and additional weapons charges in 2008.
He was sentenced to life with no chance of parole for seven years.
