An unprecedented court decision has seen the federal elections results in one GTA riding thrown out.
The judge has now ordered a by-election in the riding of Etobicoke-Centre.
In the 2011 election Liberal MP Borys Wrzesnewskyj lost to Conservative Ted Opitz by 26 votes.
This ruling has Liberals like MP Rodger Cuzner claiming victory.
“I’m very pleased for a former collogue and I’m pleased for democracy in this country that a judge made this ruling,” said Cozner.
Lawyers for Wrzesnewskyj argued that the integrity of the electoral system depended on strict adherence to procedural rules.
Dozens of ballots have been thrown out because some were from ineligible voters and others may have voted twice.
That was enough to make the final result null and void.
Conservative Ted Opitz has eight days to appeal the ruling but right now he is not saying whether he will take that route or risk his seat in a by-election.
Opitz said he is disappointed with the decision but pointed out that these mistakes were from Elections Canada and that he ran a clean campaign.
This matter is not connected to other legal challenges over the Robocall scandal, which are currently before the courts.
