TORONTO, Ont. – The owners and renters of two downtown condo buildings are suing the developers and contractors, following balcony glass-falling incidents last summer.
Law firms Falconer Charney and Sutt Strosberg have filed a class-action lawsuit on their behalf which claims $15 million each. It names the developers, contractors, manufacturers and architects as the defendants.
The suits come from residents from the Murano Towers (Bay and College Streets) and the Festival Tower (John and King Streets), which are linked to Lanterra Developments, Bay Grenville Properties and King and John Festival Corporation.
Windsor lawyer Sharon Strosberg told 680News that residents have been unable to use their balconies since several panes of glass shattered and fell last year, after which all balcony doors were sealed from the outside.
“These people haven’t been able to access their balconies for quite a long time, so we’re looking to have them compensated,” she said. “There’s some kind of special lock on it from the outside, so you can actually physically not open those doors from the inside at all, you just can’t.”
Falconer Charney’s Ted Charney said it has taken too long for the problem to get fixed, “which is one of the reasons why we’ve started this case. We’re hoping to motivate the developers to get on with it.”
“In previous Canadian cases, judges have awarded damages in the range of five to ten thousand dollars [per unit],” he added, saying his clients should be entitled to the same.
Over a thousand people are involved in the two suits.
